These Terms of Service govern your use of CestMartine.com and purchases from C’est Martine. By visiting our website, placing an order, or using our services, you agree to these Terms and our Privacy, Refund, and Shipping Policies.
ONLINE STORE USE
You agree to provide accurate and current information and to use our website only for lawful purposes.
You may not:
• Interfere with the website’s security or operation
• Introduce malicious software or code
• Use the website for fraudulent or unlawful activity
• Copy or misuse our content, branding, or designs
• Violate the rights of C’est Martine or another person
PRODUCT INFORMATION
We make reasonable efforts to display product descriptions, photographs, colors, sizes, prices, and availability accurately. However, colors may appear differently depending on your screen, lighting, materials, and production process.
Handmade, embroidered, and personalized products may contain slight natural variations. These variations are part of the custom production process and are not necessarily defects.
PERSONALIZATION
Customers are responsible for carefully reviewing all personalization information before submitting an order, including:
• Names and spelling
• Dates and numbers
• Fonts and thread colors
• Garment colors and sizes
• Design and placement selections
• Uploaded artwork, logos, and photographs
C’est Martine is not responsible for errors contained in information submitted or approved by the customer.
We may decline personalization requests that are unlawful, hateful, threatening, infringing, unsafe, technically unsuitable, or inconsistent with our business standards.
CUSTOMER-SUPPLIED CONTENT
By submitting text, artwork, photographs, logos, trademarks, or other content for personalization, you confirm that you own the content or have permission to use it.
You authorize C’est Martine to reproduce the submitted content only as reasonably necessary to communicate with you, prepare the design, and fulfill your order.
You are responsible for claims arising from content you submit without proper authorization.
ORDERS
Submitting an order does not guarantee acceptance. We reserve the right to refuse, limit, or cancel an order when reasonably necessary, including because of:
• Pricing or product-information errors
• Suspected fraud or unauthorized activity
• Product or material unavailability
• Technical or production limitations
• Inappropriate personalization requests
If we cancel an order after payment has been collected, we will refund the canceled amount.
PRICES AND PAYMENTS
Prices may change without notice. The price displayed when an order is submitted applies to that order unless there is an obvious error.
You agree to provide accurate billing information and authorize payment for the products, taxes, shipping costs, and other charges disclosed during checkout.
Payments are processed through Shopify and the payment provider selected during checkout.
PRODUCTION AND SHIPPING
Personalized and made-to-order products generally require 7–10 business days for production before shipping. Ready-to-ship boutique items generally process within 2–4 business days.
Processing and delivery are governed by our Shipping Policy. Carrier delivery dates are estimates and are not guaranteed.
RETURNS AND FINAL SALES
Personalized and custom-made products are final sale unless they arrive damaged, defective, or different from the confirmed order details.
Returns, replacements, cancellations, and refunds are governed by our Refund Policy.
INTELLECTUAL PROPERTY
The C’est Martine name, logos, original designs, photographs, text, graphics, website content, and other brand materials are owned by or licensed to C’est Martine.
You may not copy, reproduce, distribute, modify, resell, or commercially use our materials without written permission.
REVIEWS AND CUSTOMER CONTENT
If you submit a review, photograph, testimonial, or social-media mention to us, you confirm that the content is truthful and that you have the right to share it.
We will request permission before using identifiable customer photographs for promotional purposes unless you have already tagged, submitted, or shared the content with the clear intention that C’est Martine may repost it.
THIRD-PARTY SERVICES AND LINKS
Our store may use or link to services operated by third parties, including Shopify, payment providers, shipping carriers, social-media platforms, and analytics providers.
We are not responsible for third-party websites, content, availability, security, or practices.
DISCLAIMER
To the fullest extent permitted by law, the website and services are provided “as is” and “as available.” We do not guarantee that access will always be uninterrupted, secure, or error-free.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, C’est Martine will not be responsible for indirect, incidental, special, or consequential losses resulting from the use of our website, products, or services.
Nothing in these Terms limits consumer rights or remedies that cannot legally be excluded.
INDEMNIFICATION
